2.0 Customer Information
2.1 You should always check that the contact information you provide is correct before creating a customer account or proceeding with payment.
2.2 You are responsible for maintaining your own username and password, where required to access your customer account via the web site. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.
2.3 As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.
2.4 Our website is only intended for use by adults. Adults may purchase products for children as long as the products purchased are intended by the manufacturer for use or consumption by children.
3.0 Privacy Statement
3.1 Global Golfing Gadgets Limited takes your privacy seriously. Whilst we do not qualify to register under the Data Protection Act 1998 for a number of reasons and in particular because we do not collect and/or retain any of our customer’s financial information, (this is done via Pay Pal who manage our payment process and they are registered under The Act) we do comply with the principles of The Act with regard to safeguarding any and all of our customers’ information which we collect, record, retain and manage.
4.0 Product Pricing and Title
4.1 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at anytime up to the shipment of that order and any related items.
4.2 We reserve the right to alter all product pricing without notice.
4.3 Title in any products ordered from us does not pass to you, until we have received and processed a valid payment, and that payment has been made and cleared into our own bank account and your order has been delivered.
5.0 Your Order
5.1 When you place an order you will automatically receive a confirmation e-mail from us to confirm your order. Your order constitutes an offer made to us to purchase the goods specified in the order.
5.2 Your offer is only accepted by us once we have e-mailed you to confirm the dispatch of your order.
5.3 Product items not included within the dispatch e-mail are not included in the order and contract between you and us.
5.4 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
5.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.
5.6 In addition to your statutory rights, which remain unaffected by any other policies of Global Golfing Gadgets Limited, you may cancel any order placed for any products on our by notifying us in writing within seven days of placing the order. For convenience, or in the event the order was placed using our web site, you should use the form in the Contact Us section. If the order has already been serviced (despatched), please refer to Returns and Refunds below.
6.0 Shipping and Customs Duty
6.1 All orders received by us are shipped subject to availability.
6.2 We reserve the right to ship products at a later date (up to 28 days after purchase) where the product ordered is not in stock at the time of purchase or there is a delay caused by Events Outside Our Control (see below). In this situation you will be contacted and offered a full refund instead of delivery of the product.
6.3 We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control. If such disruption occurs you will be offered delivery via an alternative delivery or fulfilment company or a full refund.
6.4 If you are ordering a product from outside the UK the recipient of the product is responsible for all customs duties or tariffs incurred in the country to which the products are shipped. Furthermore your order may be subject to delay or be opened and searched by local customs authorities when entering the destination country. Please note we are unable to provide specific advice on customs duties or tariffs.
7.0 Returns and Refunds
7.1 Product Warranty
All goods come with a full 12 month manufacture warranty effective from date of purchase. If an item is delivered faulty or becomes faulty through normal use then the following shall apply:
7.2 Unused Products – Purchased From Our Web Site
In the event it is found necessary to return UNUSED product(s) to us, purchased through our Web Site, for a full payment refund, you should notify us in writing, using the form in the Contact Us section. This should be done within fourteen days of purchase.
Next, the product(s) should be returned in it’s original condition and packaging, (using a recorded delivery postal method and retaining a receipt of posting), within the next fourteen days following such notification. We regret that return costs can only be refunded where we have sent the wrong goods in error and in the event of a delay in returning the product(s) within the specified time, a Full Refund will take effect at the discretion of Global Golfing Gadgets Limited. However, this does not affect your statutory rights.
7.3 Unused Products – Purchased from Other On-line & Retail Shops
Please return the UNUSED product(s) to the store from where it was purchased. The action taken will be in accordance with their Terms & Conditions and processes for dealing with returns and/or replacements.
7.4 Used Products – Purchased From Our Web Site
In the event it is found necessary to return a USED product(s) to us, purchased through our Web Site, for a full replacement under warranty, you should notify us in writing, using the form in the Contact Us section. This should be done within fourteen days of purchase.
Next, the product(s) should be returned in packaging suitable to protect it from damage in transit. It should be returned using a recorded delivery postal method, retaining a receipt of posting, within the next fourteen days following such notification.
Upon receipt of the returned product, it will be examined to verify the cause of the fault. Should the product be found to be faulty as a result of manufacture and/or use of faulty materials, it will be replaced Free of Charge and a Credit Note refund of the return to us postage will be issued.
Upon examination should the fault/damage be determined to have been caused by any reason other than faulty manufacture or use of faulty materials, such as incorrect assembly/installation or misuse or accidental damage by the user, we regret that the warranty will be rendered void and any replacement will be at the discretion of Global Golfing Gadgets Limited. However, this does not affect your statutory rights.
7.5 Used Products – Purchased from Other On-line & Retail Shops
Please return the USED product(s) to the store from where it was purchased. The action taken will be in accordance with their Terms & Conditions and processes for dealing with returns and/or replacements in accordance with their Warranty.
8.0 Customer Complaints
8.1 In the event it is found necessary to make a complaint about anything related to Global Golfing Gadgets Limited, or dissatisfaction with any of our affiliates this should be put in writing, using the form in Contact Us. Every effort will be made to acknowledge your complaint within two working weeks and should you fail to receive a satisfactory response within the specified time or are not satisfied with the response received, please notify our Customer Service department via e-mail to customerservices@globalgolfinggadgets.co.uk and your concerns will be dealt with following a full investigation.
9.0 Events Outside Our Control
9.1 Global Golfing Gadgets Limited accepts no liability for failure to discharge its responsibilities to all Customers if this failure is a direct result of any events outside our control. Such events include but are not limited to: Manufacturing delays, stock delivery/shipping delays, postal and other strikes, malfunctions of telecommunications (internet/web site) and the like.
10.0. Copyright
10.1 All material supplied by or used, including but not limited to marketing and promotional brochures, leaflets, videos, other communiqués and electronic communications and content on our web site shall remain the proprietary property of Global Golfing Gadgets Limited and may not be reproduced or used by anyone other than by stockist, retailers and/or affiliates of the company but only in a manner in connection with the promotion of our/their company/store and its products.
11.0. Jurisdiction
11.1 These Terms & Conditions and Privacy statement shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
